Adam Duerk

Adam has extensive trial experience across a range of practice areas and a variety of cases. As a trial attorney in the private sector and a former federal prosecutor, Adam has tried cases to verdict before juries in state and federal courts, for both plaintiffs and defendants, representing corporations and individuals in civil and criminal matters. He has handled complex environmental cases and cases involving fraud and patterns of fraudulent conduct; represented individuals affected by fraud; prosecuted and defended civil cases brought against the United States under the Federal Tort Claims Act; and prosecuted cases involving political malfeasance, securities fraud, insurance fraud, elder exploitation, sexual assault, homicide, and other violent crimes.

Adam’s proven track record of navigating complicated legal matters and securing favorable outcomes for his clients has led to his reputation as one of Montana’s preeminent litigators. In 2014, he was selected as a member of the American Board of Trial Advocates, an invitation-only membership requiring a minimum of 10 civil jury trials as lead counsel resolved by verdict. In 2017, Adam received the Themis Award at the United States Attorney’s Office for his skills in handling a significant, complex white-collar matter. Adam was also recognized by the Federal Bureau of Investigation for his outstanding prosecutorial skills in 2018.

In addition to litigating cases, Adam will also focus on mediation work. After having tried dozens of cases to jury verdict over the last 20 years from a wide variety of case types on behalf of a diverse array of parties, Adam plans to bring his litigation experience to bear as a mediator for all case types. Whether your need for a mediator involves a personal injury lawsuit, Federal Tort Claims Act disputes, railroad cases under the FELA, property issues, breach of contract and commercial disputes, construction litigation, product liability matters, Title IX cases, wrongful termination claims, medical malpractice, or professional negligence of any kind, Adam has litigated these types of cases himself. He is happy to serve as a mediator for you.

Adam is a proud Missoulian by way of the East Coast. Before pursuing a career in law, Adam was an instructor and course director in the United States and Mexico for the Colorado Outward Bound School as a mountaineering, whitewater, and sea-kayaking guide for wilderness courses of 14-81 days in length in Utah, Colorado and on the Baja Peninsula. In his personal time, Adam enjoys spending time outdoors with his college-age sons.
